Engineer Requests Legal Protection From A Land Thief And Others

Samuel Oladele, a construction engineer, has requested a protection order from the Nigeria Police and alleged land squatters from the Lagos High Court in Ikeja.

 

The plaintiff issued the order in a lawsuit numbered ID/14897/MFHR/2023 against the Inspector General of Police, the Commissioner of Police, General Investigation Section ‘D’ Department, DCP, Sheik M. Danko, (Officer In Charge) Team “C,” and General Investigation Section Dy ‘department: (Force CIID) Annex, Alagbon close, Ikoyi, Lagos. The lawsuit was filed through the plaintiff’s attorney, Adetayo Sule Suraju (Aro of Abuleado) and Taye Hassan are the alleged land squatters (Alias Taye Burger)

 

Oladele is asking for a declaration that the officers of the first and second respondents, in particular the third respondent at the behest of the fourth and fifth respondents, have been repeatedly inviting him, harassing him, intimidating him, and coercing him, in violation of Sections 34(1), 35(1), (2), (3), (5 AND (6)), 36 (1), 37, 40, 41 AND 43 and Articles 3 (2), (4), (5), 6, and 7(b) and (d) of the Constitution. Orders I and ll of the Fundamental Rights (Enforcement Procedure) Rules 2009 and Cap. 10 Laws of the Federal Republic of Nigeria 1999 (as modified).

 

A finding that the applicant’s main disagreement with the fourth and fifth respondents is a land problem, which is completely civil in character and does not fit within the constitutionally mandated categories of cases and issues that the police may decide on and adjudicate.

 

He is therefore asking for a ruling declaring that the applicant’s transfer of title to the substantial parcel of land located at Samuel Oladele Ahmed layout, 6th Avenue Extension on Kuje-Amuwo, Family Land, off Lagos/Badagry-Express Road, Amuwo Odofin local council to the fourth and fifth respondents is illegal and unlawful and that he is entitled to respect for his dignity of person, personal liberty, and freedom from ongoing invitation, harassment, intimidation, and coer
